CANFLY ADVENTURE
CONTRACT AGREEMENT FOR TANDEM AND LEARNING PARAGLIDING/KAYAK/PADDLE
TERMS AND CONDITIONS :
PRICING :
Paragliding : The total price of the flight is Rs 3800.
You pay online a deposit of Rps 2000, the balance on the day of your
flight. Your ticket is valid for 1 year. If we were unable to get to fly
you due to weather conditions during this period, your deposit is
refunded. If you have not contacted us during this period or if you have
not shown up for the appointment, your deposit is cashed.
Kayak and Paddle :
The validity of your booking is 1 year from the date of the payment. If
you didn’t contact us for get your appointment during this year, your
payment won’t be refound.
RISKS :
1 I am aware that while under joying the paragliding sport/ course ( white undergoing the paragliding sports/
course and/ or associated base camp and/ or tandem flight and/ or other activities such as lodging, camping, linking,
climbing etc), in which I am participating, under the arrangement of canfly adventure and its servants, agents,
employees, associates, owners, instructors assistants, trainers, guides and officers, certain substantial risks and
dangers may occur as a part and parcel of the course including but not limited to:
- Hazards of flying parachute/ glider/ canopy in normal rough or hillwinds
- Hazard of carrying the harness/ Parachute/ glider canopy or walking/
linking on rough terrains/ maintains/ hills for the purpose of talking off or landing. - Attacks from wild or domesticated animals
- Hazards of jumping, diving, and man made hazards.
- Hazards of failure of parachute/ glider/ canopy in whatever manner. Hazards of hiring pinned under/ or against tree Rock man made objects.
- Disease as/ Allergies/ Injuries/ Pain/ Fracture/ Stains/ Organ failure/
- Partial or total Paralysis arising out of wild and rural areas and flying parachute/ glider/canopy.
- Permanent and temporary loss/ damage to personal or public property.
- Snake little, insect bite, bee sting… Failure on lack of communication equipments
- Illness or injury in remote places without medical facilities.
- Injuries occurring during take of, landing and rescue operations.
- Fall from manmade and/ or natural clif
- Hazards from the force of nature and/ or act of good
- Problems or hazards related to travel by auto bus, car or otherconveyance
- Death, accident drawing entrapment due to parachute/ glider/canopy
- Eye injury including blindness and/ or any other medical injurypossible.
- Frostbite and other cold related injuries.
2 In view of above, I hereby also agree that all the aforesaid risks and dangers may be caused by the negligence
of canfly adventure and/ or its servants agents, employees, associates, owners, instructors assistants, trainers, guides
… negligence of others, accident, breach of contract, forces of nature, act of god or other causes these aforesaid, risk
and dangers may arise from foreseeable or unforeseeable. Causes including that of canfly adventure and its servants,
agents, employees, associate, owners, instructors, assistants, trainers, guides and officers, misjudging terrain, weather
trail, wind, rain, clouds and may be unaware of any fitness or employees, associates, owners instructors, assistants
trainers, guides and officers may give in complete warnings or instructions. All the decisions of canfly adventure and
its servants, agents, employees, associate, owners, instructors, assistants, trainers, guides and officers are part of
inherent risk of undergoing the course of paragliding and/ or will not hold canfly adventure and its servants, agents,
employees, associate, owners, instructors, assistants, trainers, guides and officers liable and/ or vicariously liable, for
any risk/ danger and/ or harm and/ or loss occurred to me during the course of paragliding and/ or any other activity
with canfly adventure and its servants, agents, employees, associate, owners, instructors, assistants, trainers, guides
and officers.
3 I hereby also agree and assume all the risk (s) danger (s) and release and will held no Hern against canfly
adventure and its servants, agents, employees, associate, owners, instructors, assistants, trainers, guides and officers,
from any/ or/ all liabilities, action, cause of whatever nature which I now have of which may arise in future, in connection
with my present course or participation in any of the paragliding activity with canfly adventure.
4 I further give permission to canfly adventure and its servants, agents, employees, associate, owners,
instructors, assistants, trainers, guides and officers to use and/ or sell any of my photographs or videos that were
recorded without further compensation to me.
5 I hereby agree that all relations with canfly adventure and its servants, agents, employees, associate, owners,
instructors, assistants, trainers, guides and officers shall cause to exit at the end of the paragliding course and that
canfly adventure and its servants, agents, employees, associate, owners, instructors, assistants, trainers, guides and
officers shall not be liable for any future activity undertaken me in relation to paragliding and/or any other incidental
activity and/ or any other activity.
6 I do hereby undertake to reveal all my medical history and/ or ailments to canfly adventure and its servants,
agents, employees, associate, owners, instructors, assistants, trainers, guides and officers and also will reveal my real
identity and age.
7 I specifically agree/ undertake/ certify that I will not misbehave with any of the canfly adventure and its
servants, agents, employees, associate, owners, instructors, assistants, trainers, guides and officers or female students
undergoing the paragliding course.
8 I undertake that during the paragliding course, I will not involve/ indulge myself into consumption/use/sale of
drugs/alcohol/smoking tobacco in many forms.
9 I also hereby undertake that I will not commit any crime of whatever nature and/ or will not fight or assault any
person during the entire course/ Tandem ride.
10 I am aware that the terms and conditions mentioned on the rare side of the admission form also form an
integral part of the present agreement.
11 I also undertake to pay/ or compensate for any damage caused by me due to negligence its servants,
agents, employees, associates, owners, instructors, assistants, trainers, guides and officers. I further agree to indemnity
canfly adventure and instructors, assistants, trainers, guides and officers against and loss caused by me and paid by
canfly adventure and its servants, agents, employees, associate, owners, instructors, assistants, trainers, guides and
officers to any third party, the state of Kerala and its departments.
12 I hereby declare/ agree/ certify that I will not hold canfly adventure and its servants, agents, employees,
associate, owners, instructors, assistants, trainers, guides and officers, responsible for any action (s) risk (s) danger (s)
as mentioned above it occurred to me while undergoing the paragliding course.
13 I hereby declare/ agree/ certify that I will not hold canfly adventure and its servants, agents, employees,
associate, owners, instructors, assistants, trainers, guides and officers, responsible for the actions of independent or
quasi independent providers of activities which have been arranged for me by or recommended to me by the aforesaid
entities. I am participating for my personal reasons and understand the activities require physical exertion and involve a
challenge containing a potential risk of injury or death.
14 I further certify that during medical evacuation or rescue operation, if any ambulance medical attention or
private transportation is arranged by canfly adventure and its servants, agents, employees, associate, owners,
instructors, assistants, trainers, guides and officers, I agree to reimburse the amount incurred for the purpose of
providing said services.
15 I hereby also agree that I shall not hold canfly adventure and its servants, agents, employees, associate,
owners, instructors, assistants, trainers, guides and officers responsible for lack of any medical equipment and/ or for
providing emergency medical equipment and/ or for providing emergency medical services for eg. First aid. On call
doctor, ambulance, etc.
16 I specifically understand/ agree/ certify that I am releasing discharging and waving any claim of action that I
have presently or in future have regarding the negligent acts and or other conduct by canfly adventure and its
servants, agents, employees, associate, owners, instructors, assistants, trainers, guides and officers.
17 I am aware that the area of activity is a public area in which only minimal security is provided.
18 I hereby agree that any dispute arising between canfly adventure and its servants, agents, employees,
associate, owners, instructors, assistants, trainers, guides and officers and myself shall be subject to arbitration and the
seat of arbitration shall be at Kerala state.
19 I hereby agree that the violation of any of the terms and conditions afforested shall give canfly adventure and
its servants, agents, employees, associate, owners, instructors, assistants, trainers, guides and officers absolute right
to terminate any present courts midway without any refund and/or notice.
20 I have been given the opportunity and have been encouraged to seek advice prior to signing this agreement.
I have read the above waiver and release contract and by signing it. I agree that it is my intention to exempt canfly
adventure and its servants, agents, employees, associate, owners, instructors, assistants, trainers, guides and officers,
from liability of personal injury, property damage or wrongfulness. Death caused by negligence of any other cause. I
recognise that I am free not to participate in paragliding activity.
